You must meet the following eligibility requirements, which may be changed at any time by Blue Orbit Productions, Inc. (“Producer”) in its sole discretion, in order to apply for and/or participate in “Press Your Luck” (the “Series”) presently intended for initial exhibition on the ABC Television Network owned by American Broadcasting Companies, Inc. (“Network”)

The following are the eligibility requirements for the Series. 1. You must be at least 21 years of age or older. 2. You must be a legal resident of the United States 3. You are not an employee of Producer, Network, any of their respective parent, subsidiary, related or affiliated entities, or any other person or entity directly involved in the development, production or exhibition of the Series. 4. No member of your immediate family (e.g., spouse, mother, father, daughter, son, sister or brother or step relatives) or anyone living in your household (whether related to you or not) may currently be, or have been within the last twelve (12) months, an employee, officer or director (excluding interns or other short-term independent contractors) of any of the following: a) Producer, its licensees, assigns, parents or affiliated or subsidiary companies; b) Network and/or any other television studios and networks/platforms that comprise Disney Entertainment Television (e.g., ABC, Hulu, Disney+, 20th Television Studios, Freeform, National Geographic, FX and their affiliated television production studios) c) any person or entity directly involved in the development, production, distribution or other exploitation of the Series or any variation thereof; d) any known, major sponsor of the Series; or e) any person or entity supplying services or prizes to the Series. 5. You may not be a candidate for public office nor become a candidate for public office until at least one (1) year following the initial broadcast of the last episode of the Series in which you appear. 6. You may not have been convicted of a felony in the last ten (10) years (unless expunged). All eligibility determinations shall be made solely by Producer, in its sole discretion, and are final and binding in all respects. In addition, Producer reserves the right to render ineligible any person whom it determines, in its sole discretion, is sufficiently acquainted with the production, administration, judging, or distribution of the Series such that his or her participation in the Series could create the appearance of impropriety. Producer reserves the right to modify the eligibility requirements at any time.

In consideration of Blue Orbit Productions, Inc. (“Producer”) further considering me to become a contestant in the television series currently entitled “Press Your Luck” (the “Series”), presently intended for initial exhibition on the ABC Television Network owned by American Broadcasting Companies, Inc. (“Network”), and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, by submitting this application for the Series, I hereby agree as follows: I represent and warrant that all of the information provided on this “Press Your Luck” Contestant Application and Eligibility Requirements (“Questionnaire”) is true and accurate, and acknowledge that any false or misleading information submitted by me in connection with the Series is grounds for my immediate elimination from consideration. I irrevocably grant to Producer the right to interview me in connection with my application to participate in the Series and to film, tape or otherwise record any such interview and any other statements or actions by me in and in connection with my application and/or participation on the Series. If I have submitted or submit to Producer any material in connection with my application to become a contestant in the Series (such as, but not limited to, the attached Questionnaire, photographs, and/or videos), I represent and warrant that I own or have acquired all necessary rights in and to such submissions to grant Producer the rights granted herein. The information contained in this Questionnaire, any interview or other material that has or will be filmed, taped or otherwise recorded by Producer in connection with the Series, and any other material submitted by me including, but not limited to, pictures, film and videotapes (collectively, the “Material”), shall be deemed to be “works-made-for-hire” under the Copyright Act and shall be the exclusive property of Producer. If the Material or any part thereof is for any reason deemed not to be a “work-made-for-hire,” then I hereby irrevocably and perpetually grant and assign to Producer all rights of any nature in and to the Material that I may possess. Producer shall have the right to use or otherwise exploit, and to authorize others to use or otherwise exploit, the Material, or any portion thereof, in any manner and in any media, now known or hereafter devised, throughout the world, in perpetuity, which use shall not entitle me to receive any compensation whatsoever. Without limiting the foregoing, the Material may be edited, cut, rearranged or otherwise revised or modified, and I expressly waive any and all “moral rights” I may have with respect to the Material or Series. I understand and agree that that in the event I am selected as a contestant for the Series, and/or if I appear on the Series or any part thereof, Producer and Network are under no obligation to broadcast or otherwise use or exploit the Series or any part thereof. I further grant Producer the right to use and license others to use my name, voice, image, likeness and biographical information in and in connection with the Material and/or Series or otherwise, and in connection with advertising, programming and publicity materials for the Series (including, without limitation, in commercial tie-ins) and/or for Producer or Network and any of their respective parent, subsidiary, related entities or affiliates, sponsors of the Series, and for the institutional purposes of Producer and Network and/or their respective affiliated entities, throughout the world, in any and all media, now known or hereafter devised, in perpetuity. I acknowledge and agree that Producer has no obligation to use any of the rights granted by me herein or to return any materials submitted by me to Producer, and I grant the rights granted hereunder whether or not I am ultimately selected as a contestant. I acknowledge that Producer may determine, in its sole discretion, whether or not to select me to participate in the Series (even if I meet the Series eligibility requirements) and that Producer has the right to eliminate me from further consideration as a contestant or potential contestant at any time for any reason. Without limiting the foregoing, Producer has no obligation to interview me in connection with my application, to select me as a contestant for the Series, to produce the Series or have me appear, if selected. Further, even if I am selected as a contestant and appear in the Series, neither Producer nor Network have any obligation to broadcast or otherwise exploit, the Series, the Materials, my appearance therein, or any portion thereof. Producer reserves the right to modify the eligibility requirements at any time. I acknowledge and agree that all decisions by Producer concerning the selection of contestants is at Producer’s sole discretion, is final and binding, and is not subject to challenge or appeal. Upon Producer’s request, I acknowledge that I will agree to submit to a background check and sign the required form(s) authorizing such background check. I irrevocably authorize all such parties and persons conducting such investigations of me to disclose to Producer all information about me obtained in connection therewith. Any information obtained by Producer and its designees pursuant to the authorizations herein may be, without limitation: (a) used for evaluation of my application to participate in the Series; (b) used for purposes of selecting contestants in the Series; and/or (c) shared with Network or its designees. I hereby unconditionally and irrevocably release and forever discharge Producer, Network, any station or streaming platform broadcasting or otherwise exhibiting the Series, all persons or entities involved in with the production of the Series (including pre-production, post-production and actual production) and each of the foregoing entities’ respective parent, subsidiary and related entities, affiliates, successors and assigns, and each of their respective directors, officers, employees and agents, (collectively, the “Released Parties”), from any and all claims, damages, liabilities, costs and expenses of any kind resulting or arising out of or in connection with my participation or appearance in the Series, including without limitation, my application for the Series, contestant selection determinations and/or the exercise of any rights granted by me herein (collectively, the “Released Claims”). The Released Claims shall further include but are not limited to those based on negligence, personal injury, wrongful death, property damage, products liability, libel, slander, defamation, “false light,” invasion of privacy, publicity or personality, infliction of emotional distress, breach of contract, breach of any statutory or other duty of care owed under applicable laws and infringement of trademark, patent or copyright, and/or any other rights of a similar or dissimilar nature in connection with my application, participation and/or appearance in the Series. I understand and agree that all rights under Section 1542 of the Civil Code of California, as well as any other statute, law, or rule of similar effect of any jurisdiction throughout the world, are hereby expressly waived. Notwithstanding this provision, this agreement shall constitute a full release in accordance with its terms. To the maximum extent permitted by law, I knowingly and voluntarily waive the provisions of Section 1542 of the California Civil Code, as well as any other statute, law or rule of similar effect of any other jurisdiction throughout the world, and acknowledge and agree that this waiver is an essential and material term of this agreement. Said section reads as follows: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." I hereby agree that I will neither sue nor file any claim, complaint or lawsuit against any of the Released Parties for any of the Released Claims. I irrevocably waive any and all rights to trial by jury or to bring an action as a class to the fullest extent permitted by law. I further agree to defend, indemnify and hold harmless each of the Released Parties from and against any and all claims, liabilities or expenses (including reasonable attorneys’ fees) by whomever asserted arising from or relating to: (a) my breach or alleged breach of any representations and warranties herein; (b) my acts, statements and/or omissions in and in connection with my application for the Series; (c) the use or non-use of any of the rights I have granted herein; and (d) my violation of any law, rule or regulation. I agree that any and all claims, disputes or controversies arising out of or in connection with this Questionnaire or my application for or participation in the Series that are not otherwise barred or released pursuant to the terms herein shall be resolved exclusively and confidentially by binding arbitration before a single, neutral arbitrator, under the auspices of JAMS using its Streamlined Arbitration Rules and Procedures, through its Los Angeles, California office. I agree that my remedies for any breach of this Agreement by Producer or others will be limited to monetary damages, if any, and in no event will I be entitled to rescind or terminate this agreement or the rights granted hereunder, or to seek or obtain injunctive or any other equitable relief, including, but not limited to, seeking to enjoin, restrain, or otherwise impair the distribution, exhibition or other exploitation of the Series, its advertising, promotion, or any other exploitation thereof. I further represent, warrant, acknowledge, and agree that: (a) I have read and I meet the eligibility requirements; (b) I have the right to grant all rights granted herein and the consent of no other party is required in connection with the grant of rights herein, and Producer’s use of the Material as permitted herein will not infringe on the rights of any third party; and (c) I shall keep strictly confidential and not disclose to any third party any information I obtain through any source whatsoever about the Series, including but not limited to the application process, contestant selection process, taping locations, the identity of any host, panelist, talent or contestant in the Series, the events or outcome of the Series, and the business or creative affairs of Producer or Network. This agreement is not assignable by me, but may be freely assigned by Producer in whole or in part. This agreement shall be governed by and interpreted in accordance with the laws of the State of California. If I am selected by Producer to advance in the selection process, I agree to execute and deliver to Producer its long-form Contestant Release Agreement and Arbitration Provision and such other documents as Producer deems necessary or advisable regarding my proposed or actual participation. This agreement constitutes the entire understanding and agreement of the parties, and supersedes all prior understandings, whether written or oral. Should any provision of this agreement be void or unenforceable, such provision shall be deemed omitted, and this agreement with such provision omitted shall remain in full force and effect. I ACKNOWLEDGE AND AGREE THAT I HAVE READ, UNDERSTAND, AND AGREE WITH THE FOREGOING. I UNDERSTAND THAT I AM GIVING UP CERTAIN LEGAL RIGHTS UNDER THIS APPLICATION, INCLUDING, WITHOUT LIMITATION, MY RIGHT TO FILE A LAWSUIT IN COURT WITH RESPECT TO ANY CLAIM ARISING IN CONNECTION WITH THIS APPLICATION.
